FLAG & KO undertakes to protect the privacy of the Users of the Website by complying with the laws and regulations in force and in particular with Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms ("the Data Processing and Freedoms Law") and with European Regulation 2016/679 of April 27, 2016, which came into force on May 25, 2018, on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "the GDPR").

Thus, FLAG & KO undertakes to collect and carry out fair and lawful Processing of personal Data.

In this respect, FLAG & KO ensures that the User concerned by the Processing is informed of the purpose of this Processing, of the duration of the conservation of the processed Personal Data, of the person in charge of the Processing and the recipient of the Processing.

FLAG & KO undertakes to take the necessary measures to guarantee the security of the data it has collected and to avoid their disclosure to unauthorized third parties.

The present Personal Data Charter is an integral part of the General Terms and Conditions of Sale and Use of the Site.

FLAG & KO : designates the companies FLAG & KO, simplified joint stock company, registered at the RCS of Cannes under the number 851 395 335 and whose head office is located at 75 impasse des Faïsses, 06250 MOUGINS and ERIC FLAG SARL, foreign limited liability company, registered at the RCS of Switzerland under the number CHE-474.259.231, whose head office is located at route de Cossonay 59, 1008 Prilly, Switzerland

Cookies : are data stored in the User's terminal, used by the Site to send information to the User's browser and allowing the browser to send information back to the originating site (e.g., a session identifier, language choice or date).

Account: designates the account created by the User via the Site of FLAG & KO.

Personal data: means any information that directly or indirectly identifies a natural person.

Site : refers to the Internet site available at https://www.ericflag.com as well as its sub-domains.

User : means any visitor of the Site, professional or private individual, customer or not of FLAG & KO.

FLAG & KO processes the User's Personal Data only on the basis of one or other of the following relevant legal bases:

In compliance with the legal obligations, the Personal Data communicated by the Users to FLAG & KO are kept for the time necessary to achieve the objectives of the processing described in article 2 of the present Charter.

The Personal Data are then archived in order to respect the legal prescription and conservation periods established by law. It will then be deleted.

  • USER RIGHTS

The User concerned by the Processing of Personal Data benefits from a right of opposition that can be exercised at any time by contacting FLAG & KO under the conditions defined below. In the event that this right is exercised, the User will no longer be able to access the functionalities of the Website requiring the Processing of his data.

The User also has the right to access, rectify and delete his or her Personal Data, allowing him or her to access information concerning him or her and to demand that his or her data be rectified, completed, updated or deleted, as the case may be.

The User also benefits from a right to portability allowing him to recover the data concerning him processed by FLAG & KO for his personal use and/or to transfer them to a new organization.

The User must indicate in his request his name, first name, company name, postal address and email address and transmit to FLAG & KO a copy of an identity document so that FLAG & KO can ensure his identity.

FLAG & KO has a two (2) months deadline of answer as from the date of reception of the request of the User.

FLAG & KO undertakes to ensure the security of the User's personal Data by implementing physical, electronic and administrative technical protection measures proportionate to the risks incurred and in accordance with the applicable regulations.

FLAG & KO cannot be responsible for the risks linked to the functioning of the User's Internet network. It is the User's responsibility to ensure that the means to secure his Internet network are in place.

In the event of unauthorized access to his personal Account by a third party, the User must inform FLAG & KO by e-mail at the following address [email protected].

  1. MINOR USER UNDER 16 YEARS OLD

The Site is not aimed at Users under the age of 16 and is not prohibited to this public since it does not present content prohibited to minors under the age of 16.

FLAG & KO does not intentionally use any personal data of users under 16 years of age.

In the case where personal information relating to the User under 16 years of age has been collected by FLAG & KO, the legal representative of the latter may contact FLAG & KO in order to access, rectify, complete, update or delete this data under the same conditions as those provided for in article 6 of this Charter.

  1. UPDATE OF THE PERSONAL DATA CHARTER

FLAG & KO reserves the right to proceed to the update of the present Charter Personal data of the Site at any time and without notice.

Any change of the present Charter will be posted on the Site. In case of important changes, FLAG & KO will inform the Users and will ask for their consent if it is necessary and impacts the purpose of the collection of the Personal Data.

When using the Site, the User is required to regularly refer to the latest Personal Data Charter of the Site.

The law applicable to the present Charter is the French law.
