This Refund Policy applies to orders for physical products placed on ericflag.com with FLAG & KO.
This document supplements the General Terms and Conditions of Sale without limiting the customer’s legal rights, including the legal right of withdrawal, the legal warranty of conformity, and the warranty against hidden defects.
You have a legal right to cancel your order within fourteen (14) days of receiving it, without having to provide a reason.
If your order includes multiple products that are delivered separately, or a product consisting of multiple lots or parts that are delivered separately, the time period begins upon receipt of the last product, lot, or part.
You can exercise your legal right of withdrawal through our dedicated page: “Exercise My Right of Withdrawal.”
This page allows you to cancel the contract here by submitting your notice of cancellation online. Once you have completed the form, click the “Confirm Cancellation” button.
After submitting the form, you will receive a confirmation email indicating, among other things, the content of your declaration as well as the date and time it was sent.
You may also send us any other unambiguous statement expressing your intention to withdraw, for example by email to sav@ericflag.com.
After notifying us of your decision to cancel, you must return the applicable product(s) to us without undue delay and no later than fourteen (14) days after your notice of cancellation.
In the case of a simple return—where the product is neither defective nor non-compliant and no error is attributable to Eric Flag—you are responsible for the direct return shipping costs.
To make the return process easier, we can provide you with a prepaid return label. In this case, we will inform you of the exact cost of the label before it is issued, and this amount will be deducted from your refund, unless we decide to cover it as a courtesy.
Unless otherwise specified due to the nature of the product, the country of return, the package size, or the logistics of the return, you may also use your own method of return. In that case, we recommend that you use a tracked shipping service and keep your proof of shipment.
Return shipping costs are covered by Eric Flag the event of an error on our part, a defective product, or a product that does not meet specifications, subject to approval by our Customer Service department.
You may handle the product to the extent necessary to determine its nature, characteristics, and proper functioning.
However, you may be held liable in the event of any depreciation in the product’s value resulting from handling other than that necessary to verify its nature, characteristics, and proper functioning.
The product must therefore be returned, whenever possible, in its entirety, clean, with all accessories, any instruction manuals, and the original packaging or any other packaging that ensures safe transport.
A returned product that is incomplete, damaged, soiled, or shows signs of use beyond what is consistent with a simple inspection may be subject to a price reduction, special handling, or—under the company’s return policy for returns made after the legal deadline—a refusal of the return.
If you exercise your legal right of withdrawal within the applicable time limit, we will refund the amounts paid for the product(s) in question, including the initial standard shipping costs associated with those products.
If you have chosen a shipping method that is more expensive than the standard shipping method offered at the time of ordering, the additional charges associated with that choice will not be refunded.
The refund will be issued using the same payment method used when placing the order, unless you expressly agree to another method of refund and provided that this refund does not incur any charges for you.
We may delay the refund until we have received the product(s) in question, or until you have provided us with proof of shipment of the product(s), whichever occurs first.
If you were provided with a prepaid return label as part of a simple cancellation or a commercial return involving a non-defective product, the cost of the label will be deducted from the refund amount after you have been notified in advance.
In addition to the statutory right of withdrawal of fourteen (14) days, Eric Flag a return policy allowing returns up to thirty (30) calendar days from the date you receive your order.
This sales policy does not limit your legal rights, including your right of withdrawal, the statutory warranty of conformity, and the warranty against hidden defects.
To take advantage of this return policy after the statutory withdrawal period has expired, the product must be returned complete, clean, and not excessively used, along with its accessories, any instruction manuals, and, if possible, its original packaging.
Any product returned that is incomplete, damaged, soiled, or shows signs of use beyond what is necessary to verify its nature, characteristics, or proper functioning may be subject to a price reduction, a refusal of the return, or special handling after the customer has been notified.
In the event of a return for commercial reasons—where there is no product defect or error attributable to Eric Flag—you are responsible for the return shipping costs. We can provide you with a prepaid return label; the exact cost will be communicated to you before it is issued and will be deducted from your refund, unless we have specifically agreed to cover these costs.
In certain cases, Eric Flag offer an exchange, particularly when a product received does not match the desired size or color, provided that this option is indicated on the Website or confirmed by Customer Service.
When a free exchange is expressly offered by Eric Flag, the costs of return shipping or reshipping are covered in accordance with the terms provided by Customer Service.
Unless there is an error, a non-conformity, a product defect, or a specific commercial arrangement, the customer is responsible for return shipping costs.
If you encounter a problem with your product, if the product you received is defective or does not meet specifications, or if an error was made in the preparation of your order, please contact us at sav@ericflag.com, providing your order number and, if possible, attaching photos or videos that help illustrate the problem.
If the return is due to an error on our part, a defective product, or a product that does not meet specifications, Eric Flag will cover the return shipping costs, subject to approval by our Customer Service department.
Our products are covered by the applicable statutory warranties. This Refund Policy does not limit your rights under the statutory warranty of conformity or the warranty against hidden defects.
Our products are generally shipped from France or from a distribution center designated by Eric Flag.
For deliveries to countries outside the European Union, customs duties, import taxes, processing fees, or local charges may apply upon arrival in the destination country. You are responsible for these charges, unless otherwise expressly stated at the time of ordering.
If payment of import fees is refused, resulting in the package being returned to our warehouse, the actual costs incurred by Eric Flag return shipping, repatriation, storage, or customs processing may be deducted from the refund, after notifying the customer, subject to the consumer’s applicable legal rights.
When you use a return label provided by Eric Flag, the applicable shipping terms are those of the carrier used.
When you choose your own return method, we recommend using a tracked shipping service and keeping proof of shipment until you receive your refund.
In the event of a dispute regarding receipt of the return, proof of shipment and tracking information may be requested.
